GENERAL CONTRACT CONDITIONS


Art. 1 object

This document defines the general conditions and purchasing methods of all products sold by Albatartufi Srl Albatartufi Srl exclusively sells fresh truffles. The prices are supplied in the form of a personalised estimate upon request.


Art. 3 Minimum Orders

We can only accept orders above the following minimum quantities:

  • WHITE TRUFFLE minimum 100 grams
  • BLACK TRUFFLE minimum 500 grams


Art. 4 Payment

Cavour, 15 12046 Monta' d'Alba (Cn) Subject: our order dated placed through the internet website www.albatartufi.com Any customer requiring an invoice must say so at the moment of order and indicate the relevant VAT Code number, Fiscal Code number, or equivalent tax code used in the customer's country, on the order form.


Art. 5 Contract acceptance

Albatartufi Srl will send an e-mail confirming the order. The contract is therefore considered accepted by the Albatartufi Srl Head Office which accepts the purchasing proposal as received from the customer. In case of urgent deliveries Albatartufi Srl reserves the right to offer partial deliveries.


Art. 6 delivery

Albatartufi Srl exclusively delivers in Europe. For the service to operate in a fast and punctual manner it is important that the customer gives us precise and complete indications regarding the destination of the goods by answering correctly to the questions on the relevant form. Albatartufi Srl delivers directly to the address indicated at the moment of order; Goods en route are the responsibility of Albatartufi Srl and are covered by a full insurance policy . The weight of the goods, compared to the weight on the date of despatch , could vary by about 5% every 24 hours, owing to the natural nature of the product, or owing to a variation in the atmospheric conditions or to evaporation.


Art. 7 Withdrawal

The customer, in accordance to the italian law no. 22/5/99 N°185, has the right to withdraw from the contract and return the goods within 10 days of their receipt, by giving Albatartufi Srl advance notice by registered letter or by telegram or in writing by e-mail. In the latter two cases a copy of the advance warnng must be sent by registered letter as confirmation. Customers who have received the products must return these at their expense within 15 days of receipt. Albatartufi Srl will reimburse any advance payments made as soon as possibile and within 30 days from the moment it is informed of the right of withdrawal. The right to withdrawal is only applicable for products which are completely intact when returned and does not apply to those products, such as TRUFFLES which, owing to their nature cannot be resent or risk alteration or rapid deterioration.


Art. 8 complaints

The customer can sent any complaint in writing by ordinary mail to Albatartufi Srl or by e-mail to the following address customercare@albatartufi.com If the product does not satisfy the customer, he must be able to demonstrate that this is owing to something that is not right in the product or in its packaging.


Art. 9 competent Authority

For any problems which may arise regarding this contract the ASTI Court (Italy) is the competent authority.


Art. 10 Delay

Anything not specifically covered in this contract is subject to existing legislation. APPROVAL OF PENAL CLAUSES EX ART 1341 and 1342 C.C. According to articles. 3141 and 1342 C.C. the user declares to have read and approves all the articles in this general contract conditions : Art. 2 prices, Art. 3 payments, Art. 5 delivery, Art. 6 withdrawal , Art. 7 complaints, Art. 8 competent authority. To be able to have a written copy of this contract and the information herein for the identification of the supplier and the supply conditions, as indicated in art. 3 of Law no. 25/05/1999 no. 185 , the customer must print or save these contract conditions in the relevant computer programme. PRIVACY: respecting one's privacy The use of personal data : as indicated in art. 10 of Law no. 675/96, we inform you that all personal data regarding the customer is kept in confidential lists used only by ourselves for sending commercial information regarding both the albatartufi.com website and other interesting partner websites. Data is handled by automated and manual means and the maximum safety and privacy is guaranteed. Art. 1, comma 2 letter b of the Law is strictly followed. We furthermore inform each customer that the rights specified in art. 13 of the same Law allow him or her to request information, confirmation, updating or cancellation regarding his personal data. This can furthermore be requested in writing my e-mail. Communication via E-mail Albatartufi Srl prefers to communicate via E-mail with customers unless the customer specifically requests that the e-mail is not used. The E-Mail address is however obligatory on the form for the conclusion of the order. Guarantee safe server All action with albatartufi.com is guaranteed safe. Our server is safe and part of the server farm Bitmovers - Torino, one of the most important European internet companies. It operates by "crypting" all "sensitive" data (including names and addresses, credit card details) so that these cannot be used by others surfing on the internet. This information is inserted in a protected page covered by the Secure Socket Layer (SSL), placed on the server of the banking authority which controls and authorises all transactions for Bankpass Passwords The information regarding orders and previous purchases are protected by a password defined by the user. If you forget the password, your identity will be checked and the password used when registering will be sent to you by electronic mail.
